Terms and conditions

Commission requests submitted via email represent the initial stage of the commissioning process and do not constitute a confirmed order.

After reviewing the details provided, the artist will issue a written quote via your preferred contact. 

1. A commission will only proceed once; the client has approved the written quote and

the required deposit has been received by the artist.

The artist reserves the right to refuse or decline any commission request at their discretion.

2. Quote Validity

All quotes issued by the artist are valid for three (3) months from the date of issue.

If the quote has not been accepted and the required deposit has not been received within this period, the quote may expire.

After expiry, the client may request a new quote. The artist reserves the right to revise pricing, timelines, or availability.

 

3. Deposit Terms & Conditions

Deposit Requirement:

• A non-refundable deposit of advised amount  ( on the quote) required once the order has been confirmed.

• The commission will not be scheduled or considered booked until the deposit has been received.

Purpose of the Deposit:

• The deposit secures the client’s commission slot and compensates the artist for time spent on planning, preparation, and administrative work associated with the commission.

Cancellation by the Client:

• If the client cancels the order for any reason after the deposit has been paid, the 30% deposit will be retained by the artist and is non-refundable.

Cancellation by the Artist:

• If the artist must cancel the order due to unforeseen circumstances or events beyond their control, the client will receive a full refund of the deposit paid.

Remaining Balance:

• The remaining balance will be invoiced upon completion of the artwork unless otherwise agreed in writing.

• Full payment must be received prior to collection or shipment of the artwork.

• The artist reserves the right to withhold delivery of the artwork until full payment has been received.

Agreement:

• By paying the deposit, the client confirms they have read, understood, and agreed to these Terms & Conditions.

4. Shipping & Delivery

Shipping costs and delivery times vary depending on the destination and the size of the artwork.

Clients must provide an accurate delivery address. The artist is not responsible for delays, loss, or additional costs resulting from incorrect or incomplete address information.

If shipping costs increase due to carrier price changes, destination adjustments, or special handling requirements, the artist reserves the right to invoice the client for the additional shipping costs prior to dispatch.

Where collection is arranged instead of shipping, the client must collect the artwork from the agreed location within a reasonable timeframe after completion.

If the client requests delivery to a location that requires travel by the artist, additional costs may apply. These costs will be quoted and agreed upon in writing before delivery.

Once the artwork has been dispatched via a shipping carrier, the artist is not responsible for delays or damages caused by the shipping provider.

5. Revisions & Approval

The commission includes a reasonable number of minor revisions during the creation process, as determined by the artist.

Significant changes to the agreed concept, subject matter, or composition after work has begun may result in additional charges.

Once the artwork has been approved as complete by the client, further revisions may not be possible.

6. Completion & Storage

The artist will notify the client when the artwork is complete.

If the client fails to pay the remaining balance or arrange collection/shipping within 30 days of completion, the artist reserves the right to charge reasonable storage fees.

If the artwork remains unpaid or uncollected for an extended period, the artist reserves the right to resell or otherwise dispose of the artwork after reasonable attempts to contact the client.

In such circumstances, the client will forfeit any deposit paid, and the artist will have no further obligation to the client regarding the artwork.

7. Copyright & Usage Rights

All artwork created by the artist remains the intellectual property and copyright of the artist, unless otherwise agreed in writing.

The client receives ownership of the physical artwork only, not the copyright.

The artist retains the right to:

• display the artwork in portfolios

• share images of the work for promotional purposes

• publish the work on websites, social media, or exhibitions

The client may not reproduce or commercially distribute the artwork without the artist’s written permission.

8. Limitation of Liability

The artist will take reasonable care in the creation, handling, and packaging of the artwork.

However, the artist shall not be held liable for:

• delays caused by third-party shipping carriers

• damage occurring during transit once the artwork has been shipped 

Events beyond reasonable control, including natural disasters, illness, or other unforeseen circumstances

9. No Refunds or Exchanges 

Once the artwork or product has been shipped or collected, all sales are considered final.

The artist does not offer refunds, returns, or exchanges once an item has been dispatched or collected by the client.

Clients are responsible for ensuring that the shipping address provided is accurate and complete at the time of order.

If an item is lost or damaged during transit, the client must contact the shipping carrier directly to file a claim, where applicable. The artist will assist with providing shipping documentation if required.

10. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the artist operates.
